BE GENERATION LOVE STUDIO (“BGL Studio”) operates this website and related services at begenerationlovestudio.com. These Terms and Conditions govern your use of the Services. By using the Services, you agree to be bound by these Terms.
SECTION A: ACCEPTANCE OF TERMS
By using the Services, you confirm you are at least 18 years of age and agree to these Terms. If you do not agree, discontinue use immediately. Your use of the Services also constitutes acceptance of our Privacy Policy and SMS Terms, which are incorporated into these Terms by reference. These Terms apply to all visitors, users, and others who access or use the Services, regardless of whether they create an account.
SECTION B: DESCRIPTION OF SERVICES
BGL Studio provides wellness, fitness, and lifestyle services including class bookings, product purchases, AI-assisted customer communications, appointment scheduling, and promotional content. We may modify, suspend, or discontinue any Services at any time without liability. Our Services include but are not limited to: in-studio wellness classes, online scheduling and booking, retail product sales, personalized wellness consultations, and AI-assisted inbound communication support. Access to certain features may require creating an account or agreeing to additional terms specific to that Service. BGL Studio is not responsible for interruptions to Services due to circumstances beyond our reasonable control, including technical failures, natural disasters, or third-party service outages.
SECTION C: ACCEPTABLE USE
Use the Services only for lawful purposes. You must not: violate any law; transmit unsolicited advertising; attempt unauthorized access to our servers; use bots without consent; impersonate any person; upload malicious code; or disrupt the Services. You also agree not to: collect or harvest personal data from other users; engage in unauthorized commercial solicitation; post content that is harmful, threatening, harassing, or discriminatory; or interfere with the proper functioning of the Services. We reserve the right to terminate access for any user who violates these terms. Suspected violations may be reported to studio@begenerationlove.com.
SECTION D: SMS AND TEXT MESSAGE COMMUNICATIONS
Consent is obtained verbally during inbound phone calls. Our AI assistant asks: “Would you like me to send that information to your phone as a text message?” SMS is only sent after the caller explicitly agrees. This verbal agreement constitutes express written consent to receive SMS messages.
SMS communications are also governed by our SMS Terms of Service at https://www.begenerationlovestudio.com/pages/sms-terms. Msg and data rates may apply. Msg frequency varies. Reply STOP to opt out. Reply HELP for assistance or email studio@begenerationlove.com. No mobile numbers or SMS consent data are shared with third parties for marketing. SMS messages you may receive from BGL Studio include, but are not limited to: appointment reminders, class schedule updates, promotional offers, wellness tips, and service-related notifications. You may opt out at any time by replying STOP. Your consent to receive SMS messages is not a condition of purchasing any goods or services from us.
SECTION E: INTELLECTUAL PROPERTY
All website content is owned by BGL Studio or its licensors and protected by law. You may not reproduce, distribute, modify, or exploit any content without prior written consent. This includes all text, images, logos, graphics, audio, video, software, data compilations, and the overall design and appearance of the Services (collectively, “BGL Studio Content”). The BGL Studio name, logo, and all related branding are trademarks of BGL Studio or its affiliates. You may not use any of our trademarks without our prior written permission. Any ideas, suggestions, or feedback you voluntarily provide about the Services may be used by BGL Studio freely and without compensation or obligation to you.
SECTION F: PURCHASES AND PAYMENTS
All purchases are subject to our pricing and refund policies. We may refuse or cancel any order. Prices may change without notice. Payment is processed by secure third-party processors; we do not store full payment card information. Product and service prices are subject to change at any time without prior notice. Completed service appointments may be subject to cancellation fees as described at the time of booking. BGL Studio reserves the right to cancel or void orders placed in error or in violation of these Terms.

THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. BGL Studio does not warrant that the Services will be uninterrupted, error-free, or free of harmful components. You use the Services entirely at your own risk. We make no warranties regarding the accuracy, completeness, or reliability of any content provided through the Services. Some jurisdictions do not permit the exclusion of implied warranties; in such cases, the above disclaimer applies to the fullest extent permitted by applicable law.
SECTION I: LIMITATION OF LIABILITY
BGL STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR AMOUNTS PAID BY YOU IN THE PRIOR TWELVE MONTHS. This limitation applies regardless of the legal theory under which such damages are sought, whether in contract, tort, negligence, strict liability, or otherwise, and even if BGL Studio has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability; in such jurisdictions, our liability shall be limited to the fullest extent permitted by law.
SECTION J: INDEMNIFICATION
You agree to indemnify BGL Studio from claims arising from your use of the Services, violation of these Terms, or infringement of third party rights. This includes claims arising from your use or misuse of the Services, content you submit or share, or your violation of any applicable laws or regulations. BGL Studio reserves the right, at its own expense, to assume exclusive defense and control of any matter subject to indemnification. You agree to cooperate with BGL Studio’s defense of any such claims and not to settle any such claim without BGL Studio’s prior written consent.
SECTION K: DISPUTE RESOLUTION AND GOVERNING LAW
These Terms are governed by Florida law. Disputes shall be resolved in state or federal courts in Miami-Dade County, FL. Before filing, contact studio@begenerationlove.com for informal resolution (30-day resolution period). If informal resolution is unsuccessful, disputes shall be submitted to binding arbitration in Miami-Dade County, FL, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights. You waive any right to participate in a class action lawsuit or class-wide arbitration.
SECTION L: CHANGES TO TERMS
We may update these Terms at any time. Changes are effective upon posting. Continued use constitutes acceptance. We will make reasonable efforts to provide notice of material changes by posting an update on our website. If you disagree with revised Terms, you must stop using the Services. We encourage you to periodically review these Terms so you are aware of any updates.
SECTION M: SEVERABILITY
If any provision is unenforceable, it will be modified minimally or severed, with other provisions continuing in effect.
SECTION N: ENTIRE AGREEMENT
These Terms, our Privacy Policy, and SMS Terms constitute the entire agreement between you and BGL Studio.
